These Terms of Service (“Terms”) govern your access to and use of this website (the “Site”), operated by KnottyRestraints, doing business as Humbler and Harness (“KnottyRestraints,” “we,” “us,” or “our”), a business registered in the State of California with a principal address at 528 Tivoli Ct., Hemet, CA 92543. By accessing or using the Site, placing an order, or confirming your age at the entrance gate, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility and Age Requirement
This Site sells adult-oriented bondage and BDSM equipment and is intended for adults only. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to browse, purchase from, or otherwise use this Site. By using the Site you represent and warrant that you meet this requirement. We reserve the right to refuse service, cancel orders, or terminate access if we have reason to believe a user does not meet it.
2. Products and Product Use
KnottyRestraints sells restraint devices, bondage equipment, and related adult lifestyle products for use between consenting adults. These products are not toys, are not intended for unsupervised or inexperienced use, and are not evaluated or approved by the U.S. Food and Drug Administration or any other regulatory body as medical devices. Nothing on this Site is medical advice.
You are solely responsible for informing yourself about the safe use of any product you purchase, including material composition, restraint and circulation risks, proper use of safety releases, and the use of a safe word or equivalent system. Products must be used only between consenting adults and only in a manner consistent with applicable law. We strongly recommend never using restraint or impact equipment on a person without a clear, ongoing, freely given agreement between all parties, and never leaving a restrained person unattended.
3. Orders, Pricing, and Payment
All prices are listed in U.S. dollars and are subject to change without notice. Payment is processed through our third-party payment processor, Paykings; we do not store your full card number on our servers. We reserve the right to refuse, limit, or cancel any order at our discretion, including for suspected fraud, pricing errors, or inventory issues, and to issue a refund if we do so. Your statement descriptor will appear discreetly and will not identify the specific products purchased.
4. Shipping and Fulfillment
KnottyRestraints fulfills many orders on a drop-ship basis through third-party wholesale distributors. As a result, items in a single order may ship separately and arrive in more than one package and at different times; packaging is plain and does not reference the contents or KnottyRestraints/Humbler and Harness by name on the outside; and delivery estimates are approximate and not guaranteed, since we do not control carrier performance. Risk of loss and title for products pass to you upon delivery to the carrier.
5. Returns and Refunds
Returns and refunds are governed by our separate Return Policy, available in the site footer. Because of the intimate nature of many of our products, opened, used, or hygiene-sensitive items are generally not eligible for return except where required by law or where a product arrives defective or materially different from what was ordered.
6. Account Registration
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@knottyrestraints.com if you suspect unauthorized use.
7. Prohibited Conduct
You agree not to: use the Site for any unlawful purpose; attempt to access the Site’s non-public areas or systems; interfere with the Site’s security or normal operation; misrepresent your age or identity; use the Site to harass, harm, or attempt to coerce another person; or resell products purchased from the Site without our written permission.
8. Intellectual Property
All text, graphics, logos, product photography, and other content on the Site, other than content licensed from our suppliers, is the property of KnottyRestraints/Humbler and Harness or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, or use it without our prior written permission.
9. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE PROHIBITED BY LAW.
10. Assumption of Risk and Limitation of Liability
You acknowledge that bondage and BDSM equipment carries inherent physical risk, and you assume that risk voluntarily and knowingly when you purchase and use our products. To the maximum extent permitted by law, KnottyRestraints/Humbler and Harness will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or damage arising from the use or misuse of any product purchased on the Site. Our total liability for any claim arising from your use of the Site or a product will not exceed the amount you paid for the product giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless KnottyRestraints/Humbler and Harness, its owners, and employees from any claim or demand, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, or your use or misuse of any product purchased through the Site.
12. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to personal jurisdiction there.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
